Treating intestinal E. coli infection with antibiotic may reduce duration of bacterial carriage March 15, 2012 No Comments

ScienceDaily (Mar. 13, 2012) ? In the E coli outbreak in Germany in May 2011, treatment with azithromycin was associated with a lower frequency of long-term carriage of the bacteria and shorter duration of shedding of the bacteria in stool specimens, according to a study in the March 14 issue of JAMA.

“Since May 2011, a large outbreak of Shiga toxin-producing Escherichia coli (STEC) has caused 3,816 documented infections in Germany, including 845 confirmed cases of hemolytic uremic syndrome [HUS; a condition characterized by the breakup of red blood cells and kidney failure],” the authors write. “According to existing recommendations, antibiotic treatment of STEC infection is discouraged because this therapy might increase the risk of HUS development.” The researchers add that long-term carriage can cause persistent diarrheal symptoms. “Moreover, long-term carriers of enteropathogenic [capable of causing disease in the intestinal tract] bacteria represent a chronic risk of human-to-human transmission and, therefore, their individual social and working life is legally restricted by the German health authorities, posing a high psychological and socioeconomic burden.”

For this outbreak, data on long-term STEC carriage have not as yet been published. Martin Nitschke, M.D., of the University Hospital Schleswig-Holstein, Lubeck, Germany, and colleagues analyzed the duration of bacterial shedding in patients with this infection, comparing those who received azithromycin with those without antibiotic treatment. A substantial number of patients in this outbreak received prophylactic azithromycin treatment as part of a therapeutic regimen with the C5 antibody eculizumab. The study included 65 patients with STEC infection, including patients with HUS as well as STEC-infected outpatients without manifestation of HUS, between May 15 and July 26, 2011, and who were monitored for an average of 39.3 days after onset of clinical symptoms.

The initial azithromycin-treated group included 22 patients, and the control group included 43 patients without antibiotic treatment. On average, patients treated with azithromycin started therapy 11.8 days after the onset of clinical symptoms. There were no significant differences in the age or sex distributions between the groups.

The researchers found that the number of STEC carriers was significantly lower among patients treated with azithromycin. “At day 21, rates of STEC carriage were 31.8 percent in the initially treated group and 83.7 percent in those not treated. Long-term carriage (at day 28) was 4.5 percent in the treated group and 81.4 percent in the untreated group. At day 35, no patient in the treated group was a STEC carrier and all patients remained STEC-negative after the completion of 14 days of treatment. In contrast, 25 of 43 patients (57.7 percent) in the control group were STEC carriers at day 42 after onset of clinical symptoms.”

Additionally, the observation of rapid clearance of STEC in stool specimens among azithromycin-treated patients and the high rate of long-term STEC carriage in the control group led to the decision to provide azithromycin treatment for 15 patients with remaining symptoms. After completion of treatment, all patients had at least 3 STEC-negative stool specimens. There were no signs of HUS induction due to azithromycin therapy.

“These findings warrant confirmation for other STEC strains, as well as prospective evaluation and possible clinical trials.”

Syria forces pound Daraa as opposition in disarray No Comments

BEIRUT (AP) ? Syrian forces fired tanks and machine-guns Wednesday in an attack on the southern city where the anti-government uprising began, propelled by recent military victories over rebels as the opposition fell into disarray.

At least two prominent Syrian dissidents said they have quit the main opposition group, the Syrian National Council, calling it an “autocratic” organization.

The opposition has been hobbled by disorganization and infighting since the popular revolt against President Bashar Assad began a year ago. Its international backers have repeatedly appealed for the movement to pull together and work as one unit.

Even before the high-level resignations, the opposition was already reeling from significant losses over the past few weeks when rebel fighters were largely driven out of two key strongholds ? the city of Idlib near the northern border with Turkey and the Baba Amr district in the central city of Homs.

After retaking Idlib earlier this week, government forces launched new attacks Wednesday on Daraa, the birthplace of the uprising.

A Jordan-based spokesman for the rebel Free Syrian Army, Muneef al-Zaeem, said there were tanks in the area and reports of dead and wounded, but that numbers could not be confirmed.

“We are not able to leave our houses. People are panicking because of the shooting,” Daraa resident Abu Ahmed told The Associated Press by phone. “We are fearful because the shells can explode and kill everybody present in our homes.”

The series of government assaults on opposition strongholds has only intensified international pressure on Assad. The U.S. had said it was considering military options to aid the Syrian rebels. But President Barack Obama said Wednesday that military intervention in the conflict would be premature, could lead to civil war and more deaths.

French President Nicolas Sarkozy likened Assad to a “murderer.”

However Russia, which has remained a steadfast ally to Assad, said it would continue arming his regime ? reflecting the ongoing divisions in the international community over how to bring the violence in Syria to an end.

Although most countries are unwilling to get involved in the conflict, for fear of a protracted battle and a possible civil war, there have been widespread calls for the opposition to unite and speak with one voice against Assad.

Indeed, Assad’s greatest advantage has been the weakness and lack of unity among the disparate forces opposing him. The groups have various ideologies and motivations, from secular forces to religious conservatives to outright radicals.

On Wednesday, the opposition’s disarray was on display.

Kamal al-Labwani, one of the dissidents who announced his resignation from the Syrian National Council, said the 270-member organization was run autocratically. He even compared it to Assad’s ruling Baath party.

He blasted council chief Burhan Ghalioun and others in the SNC.

“They are trying to build an autocratic rule inside the council,” said al-Labwani, who worked for years against the Assad family regime before being jailed in 2005. He joined the council soon after being released in November.

“There is no group work. Everyone is working by himself and the whole council has not met once,” confirming outside observations about the lack of unity in the movement.

He said that another council member, Catherine al-Talli, also quit and said he expected many more to follow suit soon.

Neither Ghalioun or al-Talli could be reached for comment. Council spokeswoman Bassma Kodmani did not respond to an email requesting comment.

Another dissident, 80 year-old lawyer Haitham al-Maleh, also said he quit over lack of cooperation in the council.

“There is no transparency and there is no respect for other opinions,” he said. “They aren’t given the work the attention that it needs to fulfill the ambitions of the Syrian people.”

Both men said they would remain involved in the quest to topple Assad. Al-Labwani called for an international conference to be held in Turkey to make the council more democratic while al-Maleh said he was working to build support for armed rebels of the Free Syrian Army.

The U.S. and many European and Arab countries have said Assad must go but remain opposed to military intervention. Joint U.N.-Arab League envoy Kofi Annan ended his first visit to Syria Sunday without obtaining a cease-fire to make way for political dialogue.

Also Wednesday, Amnesty International said Syrian security forces routinely torture people detained during the uprising. The London-based group said detainees are beaten with sticks, cords and rifle butts. Others are sexually assaulted or killed.

The torture appears to be part of a strategy to punish and intimidate dissidents, the group said in its report.

“Torture and other ill-treatment in Syria form part of a widespread and systematic attack against the civilian population, carried out in an organized manner and as part of state policy and therefore amount to crimes against humanity,” according to the report.

Amnesty’s report was based on interviews in mid-February with dozens of Syrians who had fled to neighboring Jordan. Twenty-five said they had been tortured or ill-treated.

The group said it has documented 276 cases of death in detention since the uprising’s start. But given the large number of people who have been detained, it says the number of those killed is likely much higher.

The report also accuses armed opposition groups of kidnapping and killing people believed to be associated with the regime. Syrian officials were not immediately available for comment.

The Pinterest furore ? the legal implications of signing up to the … March 13, 2012 No Comments

I only became aware of Pinterest late last month when I chanced upon a blog from a former Pinterest user, a lawyer who is also a photographer. She had read the terms and conditions of the site and decided she disliked what she saw so much, she deleted her boards from the site. Her blog has gone viral in the weeks since as people realise their legal vulnerability, hidden in the site’s terms.?

But I’m getting ahead of myself: Pinterest ? what is it?

Pinterest is a social photo sharing site which bills itself as an ‘online pinboard’. A user who registers then can create ‘boards’, essentially a themed group of pictures ‘pinned’ to each board. These boards are then available to be browsed by other Pinterest users, who can also comment on the pictures pinned. ?However, although you may ‘pin’ your own photos to a board that you create, the site’s own guidelines on etiquette discourage ‘self-promotion’. The question then arises, if you are not meant to pin your own photographs, whose can you pin??

Alarm bells started ringing for Kirsten, the lawyer/photographer who investigated Pinterest’s terms and conditions, when she found that some photographers who had their pictures ‘pinned’ were starting to complain about violations of copyright. Upon checking their terms again, she found that Pinterest users are required to obtain permission from the copyright holder for any photos that they pin on their boards, and furthermore they are solely liable for any work they pin. How many people do you think would email the copyright holder first before pinning their pictures up, assuming they know who that might be? Exactly, and right there the whole idea of the ‘online pinboard’ falls apart.?

Kirsten had always made a point of crediting the original photographer when pinning anything to her boards, as the etiquette guide says to do, but realised that this is not the same as actually having consent from the original owner to do that, so investigated further.?

She investigated the section on US copyright law dealing with ‘fair use’; that is the right to use portions of a copyrighted work without consent under certain circumstances. Although judging what is and what is not ‘fair use’ can be a grey area, the law states that for the purposes of criticism, comment, news reporting, research, or teaching, a portion of a copyrighted work may be used.?

Unfortunately for Pinterest and its members, pinning a photograph on a Pinterest board is none of those things.?

According to Kirsten, the outcome of the case of Kelly vs Arriba Soft Corporation is likely to be the one on which Pinterest’s whole site relies upon. In that case, a photographer sued a search engine for the unauthorised use of images in its search results. The photographer lost, as the images used in the search engine results were only thumbnails as opposed to the entire work. Again, this is a grey area, warns Kirsten, as thumbnails may or may not constitute ‘fair use’ and a lot depends on whether only the ‘necessary portion’ of the image is used or not.?

However, Pinterest boards do not use thumbnails. Pinterest takes the image at the same size and resolution as the original source, and pins it to the board. So ? Pinterest etiquette says that you are not supposed to pin your own work up (excessively) as it is ‘self-promotion’, but legally, you can only pin other people’s work if you have explicit permission from the copyright owner to do so. If you fall foul of that, where do you stand??

Kirsten once again went back to the terms and conditions and what she found there horrified her.?

When you sign up, the terms do state that users must agree not to violate copyright or any other laws, but the section in ALL CAPITALS is the scary part. It says, and I’m quoting directly from their terms:

“YOU ACKNOWLEDGE AND AGREE THAT, TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE ENTIRE RISK ARISING OUT OF YOUR ACCESS TO AND USE OF THE SITE, APPLICATION, SERVICES AND SITE CONTENT REMAINS WITH YOU.”

So, if you do violate copyright, however inadvertently, on your own head be it. It gets better ? again from the terms, but not in caps this time at least:

You agree to defend, indemnify, and hold Cold Brew Labs, its officers, directors, employees and agents, harmless from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with (i) your access to or use of the Site, Application, Services or Site Content, (ii) your Member Content, or (iii) your violation of these Terms.

In other words, if you are sued by a photographer, you must pay both for your own defence lawyer AND for Pinterest’s lawyer. If you lose, then not only must you pay damages against yourself, but you must also pay damages against Pinterest. Furthermore, Pinterest themselves reserve the right to prosecute users who violate copyright laws.?

Having sifted through all of that, it is no surprise that Kirsten decided (reluctantly, she says) to delete her boards on the site. Most of us are not lawyers, and most of us are not professional photographers either. She is to be thanked for flagging up such draconian terms and conditions, which the majority of users simply will not see and if they do, will not understand their full implications.?

As a follow-up to this story, only last week, Kirsten was contacted by Pinterest co-founder Ben Silbermann who confirmed in a conversation with Kirsten that Pinterest were working on a solution and promised changes “in the very near future”. She added that he described himself as “a guy with a computer who had a vision”, and not an expert on copyright law. He even asked for suggestions, she said.

Despite the hopeful tone of Kirsten’s follow-up blog, the question remains: why is all liability loaded onto the user that way and if Ben Silbermann really doesn’t understand copyright law, why launch a site that can potentially put its users in a very sticky situation??

Pinterest is currently getting attention from online entrepreneurs as a way of generating traffic to their sites, it’s certainly something I would like to look into. But I won’t sign up for a site that loads legal liability so completely onto its users, however seductive its interface is.

I await the outcome of the changes to Pinterest’s terms with interest.?
